Independent Legal Representation
What is Independent Legal Representation?
Independent Legal Representation (ILR) refers to retaining a lawyer to act exclusively on behalf of an individual or entity in a legal matter. The lawyer provides advice, negotiates on behalf of the client, and represents them in legal proceedings, ensuring that the client’s interests are fully protected.
When is ILR Required?
- Criminal Law:
- When an individual is charged with a criminal offense and needs a defense attorney.
- Family Law:
- In matters such as divorce, child custody, spousal support, and adoption.
- Civil Litigation:
- For disputes involving contracts, failed real estate transactions, personal injury claims, property disputes, and other civil matters.
- Business Law:
- When forming, dissolving, or operating a business, including drafting contracts, handling disputes, and compliance issues.
- Estate Planning and Probate:
- For creating wills, trusts, and handling the probate process.
- Real Estate Transactions:
- During purchase or sale of property, and for resolving disputes related to real estate.
- Private Lending:
- In a transaction where the lender is private, the borrower has to retain their own lawyer, who works in/owns a separate law firm than the lender lawyer’s and can provide the borrower with Independent Legal Representation (ILR).
Importance of ILR
- Expert Legal Guidance:
- Provides clients with expert advice on their legal rights and obligations.
- Representation in Legal Proceedings:
- Ensures that clients are properly represented in court or during negotiations, enhancing their chances of a favorable outcome.
- Conflict Resolution:
- Helps in resolving disputes efficiently, potentially avoiding lengthy and costly litigation.
- Protection of Interests:
- Ensures that the client’s interests are prioritized and protected throughout the legal process.
- Compliance and Risk Management:
- Helps clients comply with laws and regulations, mitigating potential legal risks.
The ILR Process
- Consultation:
- The individual meets with an independent lawyer who receives and reviews the relevant documents received from the other party’s lawyer.
- Explanation:
- The lawyer explains the contents of the document, the rights and obligations of the individual, and the potential risks and consequences during their meeting.
- Assessment:
- The lawyer assesses whether the individual understands the information provided and is signing voluntarily.
- Completion:
- After the ILR documents are signed, the ILR lawyer provides them to the other party’s lawyer so that the particular transaction, for which ILR was provided, can be completed.
- ILR Lawyer’s Fees
- Either the individual getting the Independent Legal Representation (ILR) pays the ILR Lawyer directly/from their private mortgage proceeds or if applicable, the other party’s lawyer adds it to their ledger as expense and then pays to the ILR lawyer.
