What is Independent Legal Representation?

Independent Legal Representation (ILR) refers to retaining a lawyer to act exclusively on behalf of an individual or entity in a legal matter. The lawyer provides advice, negotiates on behalf of the client, and represents them in legal proceedings, ensuring that the client’s interests are fully protected.

When is ILR Required?

1. Criminal Law:
   • When an individual is charged with a criminal offense and needs a defense attorney.
2. Family Law:
   • In matters such as divorce, child custody, spousal support, and adoption.
3. Civil Litigation:
   • For disputes involving contracts, failed real estate transactions, personal injury claims, property disputes, and other civil matters.

3. Assessment:
   • The lawyer assesses whether the individual understands the information provided and is signing voluntarily.
4. Completion:
   • After the ILR documents are signed, the ILR lawyer provides them to the other party’s lawyer so that the particular transaction, for which ILR was provided, can be completed.
5. ILR Lawyer’s Fees
   • Either the individual getting the Independent Legal Representation (ILR) pays the ILR Lawyer directly/from their private mortgage proceeds or if applicable, the other party’s lawyer adds it to their ledger as expense and then pays to the ILR lawyer.
